Terms of Service

1. Introduction and Acceptance of Terms

By booking services with Top of the Valley Pet Resort (“TOTV,” “we,” “our”), the pet owner (“Owner,” “you”) acknowledges, understands and agrees to the following Terms and Conditions. These Terms apply to any pet boarding, daycare, grooming, training or other related services provided by TOTV. Submission of a reservation request, signed intake forms, or your pet’s arrival on property constitutes full acceptance of these Terms.

2. Vaccination, Health and Parasite Requirements

2.1 Required Vaccinations (Dogs)

Owners must provide proof from a licensed veterinarian of the following vaccinations:

-Rabies
-Distemper/Parvo (DHPP, DAPP)
-Bordetella (Kennel Cough) – with administration date occurring at least two weeks prior to the start date of the dog’s stay at TOTV
-Any additional vaccines which may be recommended by TOTV for public health concerns

Vaccination records must be current prior to arrival. TOTV may refuse services if proof is not provided.

2.2 Health and Illness

Owner certifies that their pet is:

-Free of contagious illness
-Free of parasites (fleas, ticks, intestinal worms)
-In overall good health to board

TOTV reserves the right to refuse or discontinue service for any pet showing signs of illness, severe stress, injury or conditions that place other pets or staff at risk.

3. Behavioral Requirements

3.1 General Behavior

Owner confirms their dog has no history of aggression toward people or animals. Dogs demonstrating dangerous or aggressive behavior may be separated, limited to private care, or dismissed from the facility.

If Owner wishes to board a dog with known dog or animal aggression, they must disclose this information to staff so that safety accommodations can be made.

3.2 Anxiety, Escape, Destruction and Self-Injury Disclaimer

Some dogs experience anxiety when away from home. This may result in behaviors including (but not limited to):

-Attempting to climb or chew fencing or enclosures
-Scratching walls or doors
-Chewing bedding or toys
-Excessive pacing, drooling, barking, or panting
-Pawing at crate doors or enclosures

Such behaviors can lead to self-injury, broken nails, broken teeth, scrapes, cuts or ingesting foreign materials.

TOTV is not liable for injuries or veterinary expenses that result from a pet’s anxiety-based, destructive, or escape-driven behaviors. Owner assumes all financial responsibility for injuries sustained or damage caused by their pet’s actions.

4. Elderly Dogs and Pre-Existing Conditions

4.1 Senior Pets

Elderly dogs are at greater risk for:

-Stress-induced medical episodes
-Mobility issues
-Heat/cold intolerance
-Sudden decline
-End-of-life events

TOTV will always provide compassionate care. However, Owner acknowledges that elderly pets may pass away naturally due to age or illness during their stay, and TOTV is not responsible for natural causes or progression of existing medical conditions.

4.2 Medically Fragile or High-Risk Pets

Owners of pets with known conditions (e.g., heart disease, seizures, diabetes, chronic illness) must disclose all details before boarding. TOTV may decline high-risk pets or require veterinary oversight.

5. Feeding, Medications, Personal Items and Shared Kennels

5.1 Feeding

Owners may provide their own food to maintain routine. TOTV is not liable for digestive upset, diarrhea, or vomiting due to:

-Sudden diet changes
-Stress
-Ingestion of personal items brought from home

5.2 Medication Administration

TOTV will administer owner-provided medications according to instructions. TOTV is not responsible for adverse reactions, missed doses due to inaccurate labeling, or medications that require veterinary supervision.

5.3 Personal Belongings

Bedding, toys, or other items left with pets may become damaged or lost. TOTV is not responsible for replacement.

5.4 Shared Kennel Disclaimer for Multiple Dogs

Dogs from the same household may share a kennel at the Owner’s request. While most bonded dogs do well together, the boarding environment can trigger stress, resource guarding, or unexpected behavioral changes. TOTV staff monitor for red-flag behaviors; however, fights between same-household dogs can occur without warning, especially around food, toys, bedding, or stress triggers. Owner agrees that TOTV is not liable for injuries, altercations, or veterinary expenses resulting from dogs housed together by Owner request, and Owner accepts full responsibility for any treatment or damage that occurs.

6. Kennel Illness, Health Risks and Dog Interaction Risks

6.1 Kennel Illness and Health Risks

Owner acknowledges that kennels carry inherent risks, including exposure to:

-Canine cough
-Canine respiratory illness (CIRDC/CIRD)
-GI upset
-Parasites
-Communicable viruses or bacteria

TOTV maintains strict sanitation standards, but no facility can guarantee prevention. Owner agrees that TOTV is not liable for illnesses contracted during or after a stay.

6.2 Dog Fights, Barrier Contact and Interaction Risks

Owner understands that even with supervision, separate enclosures, temperament evaluations, and experienced staff, dogs can experience accidental interactions, barrier reactivity, fence-to-fence contact, or dog altercations. These may result in injuries such as:

-Scratches
-Bite marks or punctures
-Torn nails
-Bruising
-Lameness
-Tooth injuries
-Stress reactions

Owner agrees that TOTV is not liable for injuries, damages, or veterinary expenses resulting from dog fights, rough play, barrier contact, or unexpected behavioral reactions. Owner assumes full financial responsibility for treatment required due to such incidents.

7. Emergency Veterinary Care

7.1 Authorization

If TOTV believes, in its sole discretion, that medical attention is needed:

-TOTV may transport the pet to a veterinarian of its choosing
-Owner authorizes TOTV to seek emergency or urgent care
-Owner accepts full financial responsibility for veterinary bills

7.2 Contact Attempts

TOTV will make reasonable attempts to contact the Owner or emergency contact prior to treatment, when possible.

8. Abandonment or Unclaimed Pets

If a pet is not picked up within 7 days of the scheduled checkout date and Owner has not made arrangements:

-The pet will be considered abandoned under state law
-Ownership may be forfeited
-TOTV may rehome the pet or turn it over to appropriate authorities

Owner remains liable for all accrued fees, costs, and legal expenses.

9. Payment, Deposits, Cancellations and Drop-Off/Pick-Up

9.1 Payments, Deposits and Cancellations

-Payment is due at pickup unless pre-paid is required
-All reservations spanning three days or more and first-time reservations require deposits (subject to our cancellation policy)
-Holiday, peak season, or specialty reservations may require non-refundable deposits
-Late pickups incur additional charges
-No-shows will be charged for the full reserved stay

9.2 Drop-Off and Pick-Up

-Drop-offs and pick-ups may be made anytime between TOTV’s operating hours of 8am-5pm CST and must be made by appointment.
-Late drop-offs and pick-ups may incur late fees

TOTV reserves the right to refuse future services for repeated cancellations, untimely drop-offs/pick-ups or unpaid balances.

10. Photo, Video and Media Release

Owner grants TOTV permission to photograph or film their pet during its stay. Images may be used for:

-Social media
-Website content
-Marketing materials
-Staff communication

No compensation is provided and copyright remains with TOTV.

11. Liability Waiver and Hold Harmless Agreement

Owner agrees to hold harmless, indemnify, and release TOTV, its owners, employees and contractors from any and all:

-Claims
-Liabilities
-Damages
-Injuries
-Losses
-Veterinary expenses
-Legal fees

arising from or related to the pet’s stay, including but not limited to illness, injury, escape, behavioral issues, stress-related incidents, natural death, or acts of nature.
